- Turtle Shell Health (TSH) guarantees to create an overall marketing culture around your business that will support and garner more prospects and leads over time (within 3 months of start time of all projects). This guarantee applies to our Custom Marketing Services and Business Builder Packages.
- We guarantee to create an online marketing engine that will continue to generate more prospects and leads within each consecutive month of applying our marketing strategies.
- We guarantee to gauge web impressions and clicks and email subscriptions in reports as per our clients request.
- All work and collaboration on marketing goals must be mutually agreed upon by TSH and the Client.
- The Client understands that they must provide TSH with completed and timely assignments as required by the goals set forth in the Proposal, and that, the lack of timely submission of assignments could jeopardize some or all of the Proposal goals and efforts.
- All marketing collateral must be approved by the Client prior to printing or publishing.
- TSH is not a Public Relations firm. Although we do offer some traditional P.R. services such as writing a press release, we do not provide services in print/television ads, trade shows, or cold calling.
- TSH does not guarantee that our clients will increase their revenue or customers.
- TSH does not guarantee to sell your products or services.
- Ownership Rights: The Client shall own all rights to content provided to TSH (including text, graphics, images, animation, audio and digital components). Should TSH provide any image from its digital library, the Client is required to pay usage rights if image is selected for usage.
- Limited Warranty and Limitation on Damage TSH warrants the completed work will conform to the Proposal. If the completed work does not conform to the specifications listed in the Proposal, TSH shall be responsible for correcting the work without unreasonable delay, at TSH’s sole expense and without additional charge to the Client. The Client waives any other warranty, expressed or implied. TSH accepts no liability for any damage, loss of productivity, or loss or alteration of matter detrimental to the users’ property due to use of third party software or hardware installed or recommended by TSH.
- Assumptions: TSH will provide the number of tasks as specified in the Cost Estimate section of a proposal. Any additional tasks requested will be an additional charge based on TSH’s hourly rates. All content (copy and images) are to be supplied by the Client and TSH will follow instructions as per the Client’s specific requests.
- Project Commencement: TSH requires confirmation that an estimate is approved by the Client.
- Privacy: Parties agree that all issues concerning Privacy Act compliance are for the Client and TSH and give no warranty or undertaking that the assignment complies with or operates in accordance with the requirements of that legislation and regulations there under.
- Confidentiality: The Client and TSH acknowledge and agree that the specifications and all other documents and information related to the development of the Proposal (the “Confidential Information”) will constitute valuable trade secrets of TSH.
The Client shall keep the Confidential Information in confidence and shall not, at any time during or after the term of this Agreement, without the TSH’s prior written consent, disclose or otherwise make available to anyone, either directly or indirectly, all or any part of the Confidential Information. Excluded from the “Confidential Information” definition is anything that can be seen via public-access channels, including the Client’s website, brochures, newsletters, etc. - Contract Evaluation: Contract evaluation (which could include potential modifications, changes and/or price re-negotiation) occurs on a three-month cycle after it has been signed and agreed to by The Client and TSH.
- Cancellation: Contract cancellation may be submitted at any time. A partial refund may be provided to the Client by TSH if the Client decides to cancel halfway through a service cycle. Fees are non-refundable at the end of a cycle.
